[pt] O seguinte trabalho analisa a relação entre o aumento do fluxo migratório para o Brasil, a
atuação das organizações da sociedade civil e as mudanças na legislação migratória e de
refúgio. A partir dos casos dos imigrantes haitianos e venezuelanos, o estudo discute a
evolução das leis, desde o Estatuto do Estrangeiro (1980) até a Lei de Migração (2017), que
substituiu a abordagem securitária por uma visão humanitária baseada nos direitos humanos.
Examina-se também a Lei de Refúgio (1997) e sua interação com a nova legislação, avaliando
os impactos na integração social e econômica dos migrantes e refugiados. O artigo destaca o
papel da sociedade civil na formulação dessas normas e os desafios para a implementação
eficaz dessas políticas.
Resumo
[en] The following work analyzes the relationship between the increase in migratory flows to Brazil,
the actions of civil society organizations, and changes in migration and refugee legislation.
Based on the cases of Haitian and Venezuelan immigrants, the study discusses the evolution of
laws, from the Foreigner Statute (1980) to the Migration Law (2017), which replaced the security
approach with a humanitarian vision based on human rights. It also examines the Refugee Law
(1997) and its interaction with the new legislation, assessing the impacts on the social and
economic integration of migrants and refugees. The article highlights the role of civil society in
formulating these norms and the challenges for the effective implementation of these policies.
