[pt] O objeto de pesquisa é a autonomia dos pais no exercício da autoridade parental e a proteção da privacidade dos filhos no ambiente digital, com enfoque no fenômeno do sharenting. A dissertação busca investigar os limites jurídicos à divulgação de informações e imagens de crianças e adolescentes pelos pais, tendo como pano de fundo os direitos da personalidade desses sujeitos em desenvolvimento. Inserido na área do Direito Civil Contemporâneo, na linha de pesquisa de Prática Jurídica, com ênfase no Direito Digital, o trabalho analisa a tensão entre a liberdade parental e a autonomia progressiva das crianças e adolescentes no contexto das redes sociais. No primeiro capítulo, examina-se a autoridade parental a partir do princípio do melhor interesse da criança e do adolescente, à luz da doutrina da proteção integral e dos princípios constitucionais que orientam a tutela infantojuvenil no ordenamento jurídico brasileiro. O segundo capítulo dedica-se à análise do sharenting na era digital, abordando sua conceituação e a prática do oversharenting, bem como os impactos dessa exposição sobre os direitos da personalidade da criança e do adolescente, com especial atenção à imagem, à privacidade e à honra. No terceiro capítulo, insere-se a perspectiva da educação digital como instrumento essencial para a conscientização parental, propondo quatro critérios orientadores para um compartilhamento digital responsável: (i) a temporalidade e efemeridade do conteúdo; (ii) o consentimento progressivo; (iii) a finalidade e a necessidade da publicação; e (iv) a sensibilidade dos dados divulgados. A partir desses critérios — de caráter propositivo e não exaustivo —, pretende-se tanto orientar a conduta dos pais quanto oferecer parâmetros interpretativos ao Poder Judiciário na análise de eventuais abusos, conciliando o exercício da autoridade parental com a salvaguarda da dignidade, intimidade e autonomia progressiva da criança no ambiente virtual.

[en] The research focuses on parental autonomy in the exercise of parental authority and the protection of children s privacy in the digital environment, with particular emphasis on the phenomenon of sharenting. The dissertation investigates the legal limits of parents disclosure of digital content involving children and adolescents, against the backdrop of the personality rights of these developing subjects. Framed within the field of Contemporary Civil Law, in the research line of Legal Practice with an emphasis on Digital Law, the study examines the tension between parental freedom and the progressive autonomy of minors in the context of social networks.The first chapter examines parental authority in light of the principle of the best interests of the child, based on the doctrine of integral protection and the constitutional principles that guide the protection of children and adolescents in Brazilian law. The second chapter is devoted to the analysis of sharenting in the digital era, addressing its conceptualization and the practice of oversharenting, as well as the impacts of such exposure on the personality rights of children, with particular attention to image, privacy, and honor. The third chapter introduces the perspective of digital education as an essential tool for parental awareness, proposing four guiding criteria for responsible digital sharing: (i) the temporality and ephemerality of content; (ii) progressive consent; (iii) the purpose and necessity of publication; and (iv) the sensitivity of the disclosed data. Based on these criteria — propositive and non-exhaustive in nature — the dissertation seeks both to guide parental conduct and to offer interpretative parameters to the Judiciary in assessing potential abuses, reconciling the exercise of parental authority with the safeguarding of the dignity, privacy, and progressive autonomy of the child in the digital environment.
