[pt] A presente pesquisa busca analisar as experiências femininas na luta contra a Ditadura Militar a partir da atuação das mulheres em uma das principais instituições do período: a Justiça Militar. Esta entidade assumiu um importante papel na cadeia repressiva do regime, sobretudo com a edição do Ato Institucional número 2, em 1965, quando teve suas atribuições expandidas, passando a julgar oficialmente civis pelos denominados crimes políticos. Em um contexto de forte oposição de setores da sociedade civil ao regime ditatorial, diversas mulheres foram indiciadas e julgadas por esta justiça que, até então, era formada predominantemente por homens tanto em seu corpo institucional, como naqueles que eram ajuizados. Simultaneamente, advogados, homens e mulheres, se dedicaram à defesa daqueles que eram acusados. Buscando defender seus clientes, os profissionais do Direito tiveram que lidar com situações limites que extrapolaram os próprios usos das leis. Se o fator de gênero se apresentou como aspecto fundamental nas vivências das advogadas e das rés em função das violências vividas, os ideais de feminilidade, por vezes, se apresentaram como possíveis brechas para um grupo de mulheres. Nesse sentido, o cruzamento das fontes processuais da Justiça Militar com os depoimentos das advogadas, indiciadas e rés nos permite reinterpretar as práticas desses grupos, expandindo as próprias noções de atuação e militância política, tão presentes na historiografia sobre o período. Aqui, a História Social ilumina importantes nuances destas experiências femininas, inclusive a maneira que rés e advogados utilizaram de diferentes estratégias na elaboração das defesas, apropriando-se, muitas vezes, da gramática moral e social de gênero vigente na ditadura, transformando-a em uma ferramenta de autopreservação na arena judicial e repressiva.

[en] This research aims to analyze women s experiences in the fight against the Military Dictatorship through their roles in one of the key institutions of the period: the Military Justice System. This institution played a significant role in the regime s repressive apparatus, especially following the enactment of Institutional Act No. 2 in 1965, which expanded its functions to adjudicate civilians for so-called political crimes. In a context of strong opposition from sectors of civil society to the dictatorial regime, numerous women were indicted and tried by this justice system, which was predominantly male both in its institutional body and among those who were judged. Simultaneously, lawyers, both men and women, dedicated themselves to defending the accused civilians. In their efforts to defend their clients, legal professionals had to navigate extreme situations that went beyond conventional legal practices. While the factor of gender emerged as a fundamental aspect in the experiences of female lawyers and defendants due to the violence they endured, ideals of femininity sometimes appeared as potential openings for a group of women. In this regard, the intersection of Military Justice procedural sources with testimonies from female lawyers and defendants allows us to reinterpret the experiences of these groups, expanding the notions of activism and political engagement that are prevalent in the historiography of the period. Here, the perspective of Social History illuminates important nuances of these feminine experiences, including how defendants and lawyers employed various strategies in crafting their defenses, often appropriating the prevailing moral and social gender grammar of the dictatorship and transforming it into a tool for self-preservation within the judicial and repressive arenas.
