[pt] Em 2023, no Estado do Rio de Janeiro, 04 pessoas foram torturadas por dia, segundo relatório produzido pela Defensoria Pública do Estado do Rio de Janeiro. A presente dissertação busca analisar o grande percurso da tortura e sua relação com a estruturação do sistema penal brasileiro, para compreender o contexto atual de prevenção e combate à tortura, pela perspectiva da atuação da Defensoria. Para tanto, partimos de uma análise histórica fundada na escravidão e no racismo como marcos estruturantes e fundacionais do sistema penal no país, buscando também as suas grandes permanências com outras matrizes. Buscamos também analisar a ditadura militar brasileira e sua influência no enraizamento da violência institucional e como os debates travados à época da redemocratização influenciaram em uma tolerância institucional à violência de Estado, aprofundando e garantindo a permanência de suas práticas. Também trouxemos os principais marcos jurídicos de prevenção e combate à tortura, apresentando os tratados internacionais, os julgados da Corte Interamericana de Direitos Humanos e sua mobilização enquanto teses jurídicas perante o judiciário brasileiro. Por fim, analisamos as decisões proferidas em audiências de custódia com relação aos pedidos ligados à denúncia de tortura pelo custodiado, bem como o perfil dos agressores, agredidos e das agressões.

[en] In 2023, in the State of Rio de Janeiro, 04 people were tortured per day, according to a report produced by the Public Defender s Office of the State of Rio de Janeiro. This dissertation seeks to analyze the long use of torture and its relationship with the structure of the Brazilian penal system, to understand the current context of the institutions that aim to prevent and combat torture, from the perspective of the actions of the Public Defender s Office. To do so, we start from a historical analysis based on slavery and racism as foundational landmarks of our penal system, also seeking the influence of other law systems in ours, from this perspective. We also analyzed the Brazilian dictatorship and its role in deepening institutional violence. We also present how the debates held at the time of transition to democracy have influenced institutional tolerance to State violence, guaranteeing the permanence of its practices. At the same time, we presented the main legal frameworks for protecting people against torture, such as international treaties, the jurisprudence of the American Court of Human Rights and how the public deffenders use them to create theses before the Brazilian judiciary. Finally, we analyzed the decisions given in custody hearings in relation to the requests linked to the complaint of torture, as well as the profile of the aggressors, the victims and the circunstance of the attack.
