[pt] O presente trabalho busca responder se o desvio provisório do Rio Carioca, que deixou de desembocar na Praia do Flamengo e passou a ser conduzido pelo Coletor em Tempo Seco, percorrendo o mesmo caminho do esgoto até o Emissário de Ipanema, é aderente ao seu processo de tombamento. Para tanto, será analisada a legislação vigente sobre saneamento básico, sendo destacadas as alterações propostas pelo Novo Marco Legal do Saneamento (Lei no.14.026/2020) que buscam atender a ODS no. 6 (Saúde e Saneamento) da Agenda 2030 da ONU, mediante metas ambiciosas de abastecimento de água e de esgotamento sanitário até 2033. O estudo também abordará os sistemas de coleta de esgoto, inclusive o sistema separador absoluto, considerado ideal pela legislação ambiental. No entanto, o déficit de redes coletoras de esgoto no município do Rio de Janeiro tem levado a interconexões entre essas redes e as de drenagem pluvial, justificando o uso dos coletores em tempo seco. Como a pesquisa está centrada no Rio Carioca, serão analisados os aspectos histórico, geográfico e socioeconômico da respectiva bacia hidrográfica e a transformação da paisagem observada ao seu redor, dado que este rio foi a principal fonte de abastecimento de água para a cidade até o século XIX. Com seu tombamento em 2019, pelo INEPAC, serão avaliados o processo administrativo de tombamento e se houve consulta ao órgão responsável pelo tombamento, antes do desvio. Os resultados devem esclarecer eventual responsabilidade da Concessionáriadiante das intervenções realizadas no Rio Carioca.

[en] This study aims to address whether the temporary diversion of the Rio Carioca-redirected from discharging at Praia do Flamengo to being conducted through the Dry Weather Collector, following the same path as the sewage system to the Ipanema Outfall-aligns with its heritage preservation process. For this purpose, current sanitation legislation will be examined, with emphasis on the changes proposed by the New Sanitation Framework (Law No. 14,026/2020), which seeks to fulfill SDG 6 (Health and Sanitation) of the UN s 2030 Agenda through ambitious goals for water supply and sanitation coverage by 2033. The study will also address sewage collection systems, including the absolute separation system, which is considered ideal by environmental legislation. However, the shortage of sewage collection networks in Rio de Janeiro has led to interconnections between sewage and stormwater drainage networks, justifying the use of dry weather collectors. As the research is focused on the Rio Carioca, historical, geographical, and socioeconomic aspects of the river basin will be analyzed, as well as the changes in the surrounding landscape, given that this river was the main water supply source for the city until the 19th century. With its designation as a heritage site in 2019 by INEPAC, the study will assess the administrative preservation process and whether there was consultation with the community and the responsible agency prior to the diversion. The results aim to clarify any responsibility of the Concessionaire regarding interventions carried out on the Rio Carioca.
