[pt] A cidadania parte do princípio de que todos os homens são iguais perante a lei, sem discriminação de raça, credo ou cor, tendo direito à educação, saúde, habitação e lazer. Ser cidadão significa ter direitos e deveres dentro da sociedade. A cidadania é ressaltada não só pela legislação pátria, como também pela literatura, pelos meios acadêmicos, pelas mídias e por organismos internacionais, dentre outros. O acesso à Justiça, portanto, deve ser encarado como o mais básico dos direitos humanos. Seu estudo pressupõe um alargamento e aprofundamento dos objetivos e métodos da moderna ciência jurídica. Esta dissertação Acesso à Justiça: uma questão de cidadania tem como objetivo geral investigar a percepção adquirida pelos usuários atendidos pelo Escritório Modelo da Universidade UNINORTE sobre a atuação do EAJ e sua relação com os direitos de Acesso à Justiça. O interesse da autora desta dissertação pelo tema se dá em razão da função social que os escritórios de prática jurídica das universidades exercem ao prestarem atendimento jurídico gratuito as famílias de classes populares; atualmente, cada vez mais se observa que homens e mulheres lutam em condições de igualdade para adquirirem seus direitos civis. Além do embasamento teórico, por meio da pesquisa bibliográfica, foi feita uma pesquisa de campo, com entrevista semi-estruturada para a coleta de dados. As entrevistas foram gravadas, transcritas e posteriormente analisadas.
Resumo
[en] Citizenship is based on the principle that all men are equal before the law without discrimination of race, creed or color, having the right to education, health, housing and leisure. Being a citizen means to have rights and duties within society. Citizenship is highlighted not only by the Brazilian legislation, but also by literature and by academia, media and international organizations, among others. Access to justice must therefore be regarded as the most basic human rights. Their study assumes a broadening and deepening of the goals and methods of modern legal science. This dissertation Access to Justice: a citizenship matter aimed to investigate the perception gained by the users served by the Office of University Model UNINORTE on the role of EAJ and its relation to the rights of access to justice. The author s interest in the subject of this thesis verify itself by social function that the offices of the legal practice of universities engaged in providing free legal assistance to families of popular classes; now it is observed that men and women fight in the same conditions for their rights in relation to offspring. Beyond the literature research it was a field survey, with semi-structured interview to collect data. Interviews were taped, transcribed and then analyzed.
