Resumo:
This paper aims to present the challenges of multi-tiered dispute resolution clauses on international trade Law through the analysis of the evolution and the consequent difficulties arising out of the application and interpretation of these clauses. Throughout this paper, the new directions on the practical use of multi-step clauses will be presented, so as to acquaint the reader on the modern applications of alternative dispute resolution methods in international. Towards the end, the aim is to understand the difficulties of interpreting such clauses, through the extensive analysis of international courts and arbitral tribunal`s decisions, as well as international authorities, both Brazilian and foreign, opinions on the subject, with the purpose of reaching a conclusion on the legal and practical consequences resulting from the several existing views. Thus, it will become possible to conclude which would be the best and the most efficient way to bring the institute to Brazil, after the effective comprehension of how international trade applies and interprets multi-tiered dispute resolution clauses.
