Resumo:
The increasing implementation of Artificial Intelligence (AI) in medical practice has revolutionized diagnosis and clinical decision-making, promoting greater accuracy and speed/agility in treatments. However, its application raises ethical and legal challenges, especially regarding the physician s civil liability for the duty to inform the patient and obtain patient consent. Given this scenario, this dissertation aims to verify how the use of an Artificial Intelligence system may impact the civil liability of physicians when they use it as a tool to support decision-making in the diagnostic analysis of their patient s clinical condition and do not observe the process of granting the patient s free and informed consent. The research addresses the physician-patient relationship from the perspective of bioethics and the ethical principles of AI in medicine published by the WHO (OMS), exploring the duty to inform and the need for the patient to provide free and informed consent for the use of AI as a tool to assist in medical decision-making.
