The study consists of an analysis regarding the implementation of the Racial
Crimes Law in the State of Rio de Janeiro, with an emphasis on the interpretation
and application of racial insult and Article 20 of Law 7.716, of January 5, 1989, by
the justice system, considering all stages from the investigative phase to the
conclusion of proceedings. The research aims to identify the main challenges faced
by victims in obtaining access to justice, as well as to discuss how Institutional
Racism effectively sustains power dynamics. Additionally, it proposes the analysis
of initiatives that promote transformations and ensure access to justice for victims
of racial crimes, including the recommendations and measures issued by the
Commission and the Inter-American Court of Human Rights.
