This text analyzes the tension between freedom of expression, guaranteed by the Constitution of 1988, and the right to honor, in the context of humorous speeches. Humorous content sometimes leads to litigation, with the Judiciary seeking to balance
the protection of individual honor and freedom of expression, in an equation whose
outcome is influenced by the fact that the Constitution itself protects both rights, with
both deriving their strength from the principle of human dignity. After discussing the
theories that explain humor and the relationships between Law and humorous discourses, addressing the institutes of freedom of expression, personality rights, moral damages, and civil liability, the research focused on the decisions of the Court of Justice of Rio de Janeiro (TJRJ) regarding cases involving humor, seeking to identify patterns in judicial decisions and, primarily, attempting to find, in the rulings for compensation for moral damages due to violations of honor, which situations imply higher or lower amounts of indemnification. In the end, conclusions were drawn about the limits of humor established by the TJRJ and the value of indemnification for moral damages in cases of honor violations.
