Resumo:
This dissertation has as its central themes the excessive onerousness and the contractual imbalance arising in the fuel supply contracts. In addition to analyzing the contractual basis of the relationship and the articles set out in the Civil Code that aim to remedy the supervening contractual imbalance, this work will explore the position of Brazilian courts in lawsuits aimed at the resolution or contractual review due to supervening events that alter the circumstantial basis of the relationship. Also, the relevance of the renegotiation path will be analyzed as a solution to the possible risks caused by the unsystematic interventions of the Judiciary.
