This work aims to analyze the legal protection of older adults in the Brazilian legal system based on the notions of dignity of the human person, vulnerability, autonomy, and support. The elderly deserve special legal protection to promote their dignity as a vulnerable group. In addition to the biological aspects of aging, several other social factors aggravate the older adult s vulnerability. From the age of eighty, the elderly are identified as hyper-vulnerable human beings, as they are more intensely affected by these vulnerability factors. Vulnerability, however, does not mean legal incapacity, nor does it justify interventions in the elderly s autonomy. Autonomy is an expression of individual freedom and human dignity; the exercise of autonomy by older adults is defended in all age ranges, as well as respecting their decisions about existential and patrimonial issues. Therefore, this work considers that support systems must be adopted to encourage autonomy in older adults and offer them the security needed in the decision-making process regarding existential and patrimonial issues. Thus, based on concepts of accessibility and support, this work analyzes the applicability of supported decision-making to hyper-vulnerable older people since this legal institute already exists in Brazil. This pathway guarantees vulnerable older adults greater security in decision-making without compromising their legal capacity.
