Resumo:
We propose to investigate, in this dissertation, the identity coconstruction emerged in juridical-professional context of an adolescent charged (and imprisoned) by the supposed crime of arson from the narratives constructed by his mother, by himself and retold by the lawyers who assist them to the other members of the staff. This way, we aim at comprehending, from the (re)narratives, how the former inmate identities are constructed, projected and appraised in professional and institutional contexts and the harmful influence (psychic) that the effects of an illegal detention and media exposure image have in the participants. The meetings were analyzed in the macro and microsocial perspectives in the light of oral narrative studies oriented by Interactional Sociolinguistics; of the studies on talk-in-interaction in institutional context; and of the studies of/about identities in consonance with the post-structuralist perspectives, which de-essentialize the concept of identity and that, support its manifestation in a symbolic dimension. This research is qualitative. The data obtained are from juridical consultations that occurred in the year of 2016, in which I perform the roles of not only a lawyer, but also a researcher. It correspond to three meetings in different moments and with different purposes, in which were present lawyers and two clients who live in the same community where the office is located: the Faixa de Gaza capixaba, marked by the dispute and control of drug trafficking. Two of the meetings analyzed are categorized as legal consultation, whereas the third corresponds to re-narrative and recontextualization of the story made by the lawyers in charge of the case to the other coworkers during lunchtime, which occurred in the office and it shows itself a propitious environment to report the cases that were given to them individually. In the office, there is the law operation of approximately thirty years of a group of lawyers in defense of labor and social security laws of the community that lives in that region. In the analysis, we propose the observation in three dimensions: interactional, narrative and contextual. The story reported by the participants – the young resident of those outskirts, imprisoned for a crime he did not commit; and his mother – and reported by the group of lawyers, disclose an array of practices and set of knowledge not only of the group that forms the staff of the office but also of the members of the community. The inclusion of lawyers is ratified and made possible in that office because it offers an essential primacy to the real existence of a democratic state ruled by law: to provide the access to Justice to the marginalized voices and this is the main feature and ethic line of the group. It was observed that the (re)narrative and recontextualization of the story mad by the lawyers was favorable to the establishment not only of a group intersubjectivity but also of a common ethic construction, in which there is an identification of what the group understand that ethics posture is. Thereby, we managed to envision that the suffering shows different nuances depending on the participants who reports the deviating experience, as well as it depends on the activity performed (search for a solution of a conflict that is aimed to make judicial or an informal conversation in which a common ethics is coconstructed) and participants involved.
