This dissertation purposes analysing Public Ministry role for the social rights implementation by Public Administration. For a better understanding, in the first two chapters Public Ministry and Public Administration are studied as established in the Constitution. Following, social rights and their implementation are analysed. It is defended the conception that social rights must be considered human rights with an immediate application. The budget resources shortage can not justify public politics absence. Public politics should guarantee these social rights. A fair society will be only reached when these rights are guaranteed. Public Ministry must act for these rights implementation because this is its institutional mission described in Constitution art. 129, II, which is, looking after Public Agents effectively respect Constitutional assured rights.
