Resumo:
The present research aims to demonstrate the feasibility of abolishing modern criminal justice and to draw indicatives for a new justice to deal with severe conflicts. Based on Michel Foucault s reading on modernity, it applies this method on Criminology as a way to enable a new understanding of punitive reality in the West. Finally, it makes a political proposal in two areas, to reduce the range of criminal justice and to start the elaboration of a new legal arena based on mediation, focus on the victim and reparatory decisions.
