Resumo: | |||||||||||||
This thesis propose an issue: are there original vectors in Spinoza s work to think about private property? I defend the affirmation, from a displacement of the usual images of property to two axes of reflection that emerge from the text: (a) that of the desire to separate and guarantee the my one (right-property) and
the rule of life that we wish to establish about that desire (law-property). Rightproperty
is not the same of subjective property right (on civil law tradition). And law-property is not the act of state authority about property right. After defining the epistemological place of the thesis and its methods; after identifying the legal forms that produced the modern images of property; after characterizing the ideas,
practices and socioeconomic and political consequences of emerging capitalism over property images, the text focuses entirely on Spinoza and approaches the subject under three perspectives: knowledge theory, freedom theory and political theory. How is considered the problem of property (right or rule) under these three optics?
