Resumo
[pt] A expressão violência obstétrica é carregada de muitos
significados. Rejeitada pela classe médica, ela traduz uma incessante
busca pela ruptura com os padrões de estruturas violentas,
identificadas no mundo inteiro. Diante das controvérsias e polêmicas
que ela carrega, este trabalho pretende analisar como os discursos
jurídicos a seu respeito vem sendo construídos, especialmente no que
concerne ao Poder Judiciário, sob a perspectiva crítica feminista na
ótica de Katharine Bartlett, Roberta Cook e Simone Cusack, com
amparo na teoria da interseccionalidade. A partir da análise de tais
mecanismos, considerando fatores como o racismo estrutural, classe
e as disputas políticas que envolvem a atenção de saúde da mulher,
bem como o arcabouço legal atual, pretende-se traçar um panorama
da forma como o tema vem sendo tratado no Judiciário brasileiro. A
abordagem busca identificar se a própria expressão violência
obstétrica é utilizada nos julgados, bem como de que forma se dá a
instrução probatória no contexto de complexidades que cercam a sua
demonstração, especialmente diante das limitações do conceito de
erro médico que geralmente é associado à sua ocorrência.
Resumo
[en] The recently emerged term obstetric violence, is capable of great meaning and possibilities. Resulting from the struggle for rupture from oppressing structures of power imposed upon pregnant women s bodies in facility-based childbirth and other health services, this term is as polemic and powerful as the violence experienced by women all over the word. Considering the debates over this expression, the present research hopes to analyze the legal discourse about pregnant women s rights violation in Brazilian s Courts of Appeal, using Katharine Bartlett s perspective of feminist methods, and a genderbased violence perspective. Based on this analysis and considering facts such as structural racism, class and political disputes that surrounds women s health-care attention, as well as the legal available support, it is hoped to provide an overview of legal discourses on obstetric violence in Brazilian current legal landscape, investigating the use of the expression obstetric violence in court and the limitations caused by the concept of medical malpractice in such cases.
