[pt] O estado do Rio de Janeiro tem enfrentado no século XXI dificuldades no âmbito das capacidades estatais, especialmente na dimensão fiscal, o que tem comprometido os investimentos em geral e o atendimento as urgentes demandas sociais. Esse fato tem obrigado, nos últimos anos, a sucessivas negociações de natureza federativa junto ao Supremo Tribunal Federal e União. A principal hipótese do presente trabalho é que o estado do Rio de Janeiro, no período de 2013 a 2023, não conseguiu melhorar sua capacidade fiscal mesmo com a suspensão da nova legislação que ampara a distribuição dos royalties da exploração de petróleo e gás, ocorrida em março de 2013, através de liminar concedida pela Ministra Cármen Lúcia do Supremo Tribunal Federal. Além disso, também foi investigado os efeitos da implementação do Regime de Recuperação Fiscal, a partir do Governo Luiz Fernando Pezão, em julho de 2017, com o apoio do governo federal a fim de entender se os resultados planejados foram alcançados e se os problemas do estado na dimensão fiscal foram amenizados. A pesquisa mostrou que as duas negociações realizadas – suspensão dos dispositivos da lei de redefinição da redistribuição dos royalties do petróleo e a implementação do Regime de recuperação Fiscal de 2017 - não resolveram as questões mais estruturais do estado, apontadas na literatura especializada, tais como um processo de desindustrialização estadual, que vem de longa data, além do elevado gasto com aposentados e pensionistas, e da ausência de um projeto de desenvolvimento que potencialize as vocações econômicas estaduais.

[en] In the 21st century, the state of Rio de Janeiro has faced challenges within the scope of its state capacities, especially in the fiscal dimension, which has compromised investments in general and the ability to meet urgent social demands. This fact has forced, in recent years, successive negotiations of a federative nature with the Federal Supreme Court and the Union. The main hypothesis of this work is that the state of Rio de Janeiro, from 2013 to 2023, failed to improve its fiscal capacity even with the suspension of the new legislation governing the distribution of oil and gas exploration royalties, which occurred in March 2013 through an injunction granted by Minister Cármen Lúcia of the Federal Supreme Court. Furthermore, the effects of the implementation of the Fiscal Recovery Regime, starting from the Luiz Fernando Pezão government in July 2017 with federal government support, were also investigated to understand whether the planned results were achieved and if the state s fiscal problems were alleviated. The research showed that the two negotiations conducted—the suspension of the provisions of the law redefining oil royalty redistribution and the implementation of the 2017 Fiscal Recovery Regime—did not solve the state s more structural issues, as pointed out in the specialized literature, such as a long-standing process of deindustrialization, high spending on retirees and pensioners, and the absence of a development project that leverages the state s economic strengths.
