[pt] Foi objetivo dessa pesquisa analisar o novo COES do município do Rio de Janeiro, descrevendo suas potencialidades e fragilidades. Em relação à metodologia, fez-se tanto uma pesquisa bibliográfica quanto uma pesquisa de campo, a qual foi realizada com a aplicação de uma entrevista com servidores, arquitetos e especialistas, assim como com um dos idealizadores do COES. Analisando as amostras dos três grupos, sobre os parâmetros potenciais do COES, nota-se que o parâmetro mais citado foi a maior flexibilidade para projetar varandas, citado por 45 porcento dos entrevistados, e, em seguida, a redução de área mínima para 25 m2 e a permissão de elementos de fachada, que foram citados por 40 porcento dos entrevistados. Sobre os parâmetros frágeis, o mais citado foi a flexibilidade na exigência de vagas de estacionamento, citado por 55 porcento dos entrevistados, e, em seguida, a maior flexibilidade para projetar varandas, citado por 35 dos entrevistados. Com base nessa análise, torna-se evidente que o COES trouxe uma possibilidade de renovação no mercado imobiliário da cidade e refletiu de forma nela positiva, em virtude de ter conseguido compilar diversas legislações. Entretanto, a cidade continua com muitas legislações complexas, o que requer, ressaltamos, a necessidade urgente de revisão de alguns parâmetros. Em outras palavras, ficou claro que o COES trouxe inúmeros efeitos positivos, mas ainda é essencial que sejam realizados ajustes e alterações.

[en] The objective of this research was to analyze the new COES of the city of Rio de Janeiro by describing its strengths and weaknesses. Regarding the methodology, a bibliographical and field research was carried out with the application of an interview with civil servants, architects, and specialists. The creator of COES was also interviewed. For data analysis, qualitative (MEDs) and quantitative (Excel) methods were employed. The city of Rio de Janeiro stands out negatively when compared to other cities because its urban legislation consists in an overlap of legislations, which generates a difficulty of interpretation. The urban legislation of Rio de Janeiro has already undergone many changes. There were approvals of several decrees and laws that either varies according to previous legislations or determines stricter parameters. There was also approval of approved alignment projects, urban structuring projects, and the rules era routinely confusion and difficult and confusing interpretation. These facts, in addition to bureaucracy and delay in licensing at City Hall, have led many cariocas (inhabitants of the city of Rio de Janeiro) to risk illegality when they decide to build or expand their properties. With one of the main objectives of simplification, the COES represents a milestone in the city s urban legislation, and, since its approval, it has been the target of many positive and negative criticisms. The new COES project was paralyzed for a long time at the SMU (Municipal Department of Urban Planning) and returned at the end of 2018 to the voting agenda in the Legislative Chamber with a quick approval, without further intervention by society as a whole coming into force in January of 219. COES brings the concept of a compact city inspired by the city of Barcelona. The compact city is one that presents a structure and urban fabric of a certain compactness, it is socially cohesive, it generates spaces for sociability, it creates a territory of proximity to services, it encourages the gathering of activities and allows the development of community life.
