[pt] Esta tese analisa como o Tratado sobre a Proibição de Armas Nucleares (TPAN) configura uma contestação normativa ao status quo nuclear institucionalizado pelo Regime de Não-Proliferação Nuclear (RNPN). Por meio do engajamento ativo de Estados Não-Nuclearmente Armados (NNWS), organizações da sociedade civil e sobreviventes e vítimas de testes e uso de armas nucleares, o TPAN desafiou a lógica de segurança dominante dos Estados Nuclearmente Armados (NWS), que historicamente marginalizou concepções alternativas de segurança, de ameaça, de risco e de estabilidade. Fundamentada na Teoria da Contestação de Antje Wiener (2014; 2018), a tese examina como esses atores redefiniram o objeto de referência da segurança e problematizaram hierarquias normativas consolidadas. A tese se debruça sobre o processo por meio do qual os NNWS e atores da sociedade civil articularam uma nova gramática normativa centrada na segurança humana, na justiça, na responsabilização e na igualdade em um processo conduzido com forte oposição dos NWS. Os achados da tese evidenciam que essa coalizão de atores foi capaz de introduzir novas normas na ordem nuclear global ao priorizar dimensões historicamente negligenciadas na governança nuclear, como o sofrimento humano, os danos ambientais e os impactos de gênero. Esse deslocamento normativo foi catalisado, sobretudo, pelos testemunhos dos Hibakusha e de outras vítimas, que colocaram a experiência vivida no centro do debate e reposicionaram a segurança humana como eixo normativo. Nesse processo, revelaram as assimetrias estruturais incorporadas ao RNPN, em especial os privilégios conferidos aos cinco NWS pelo Artigo VI do Tratado de Não-Proliferação Nuclear (TNP), e impulsionaram a formulação de um novo arcabouço jurídico pautado na igualdade de direitos e obrigações. O TPAN, nesse sentido, representa uma rejeição à indefinição dos compromissos de desarmamento nuclear e à cristalização de uma hierarquia nuclear legitimada pelos NWS. Ao invés de atuarem exclusivamente dentro das estruturas convencionais do Regime, os NNWS e as organizações da sociedade civil criaram espaços normativos alternativos nos quais reivindicaram autoridade para falar, decidir e definir, desafiando proativamente o status quo nuclear. Suas ações materializam o princípio quod omnes tangit, central na abordagem de Wiener (2014; 2018): O que a todos toca deve ser aprovado por todos. O TPAN constitui, assim, não apenas uma inovação jurídica, mas uma ruptura política e simbólica que reivindica agência sobre a construção normativa no campo da segurança nuclear.

[en] This thesis analyzes how the Treaty on the Prohibition of Nuclear Weapons (TPNW) constitutes a normative contestation of the nuclear status quo institutionalized by the Nuclear Nonproliferation Regime (NNPR). Through the active engagement of Non-Nuclear Weapon States (NNWS), civil society organizations, and survivors and victims of nuclear weapons use and testing, the TPNW challenged the dominant security logic of Nuclear Weapon States (NWS), which historically marginalized alternative understandings of security, threat, risk, and stability. Drawing on Antje Wiener s Contestation Theory (2014; 2018), the research investigates how these actors redefined the referent object of security and disrupted established normative hierarchies. The work focuses on the process through which NNWS and civil society actors advanced a new normative grammar, one centered on human security, justice, accountability, and equality, without the support of the NWS. The findings demonstrate that this coalition of actors was able to establish new norms within the global nuclear order by foregrounding human suffering, environmental harm, and gendered impacts, dimensions historically sidelined in nuclear governance. This was centrally driven by the powerful testimonies of the Hibakusha, and other victims of nuclear weapons use and testing, which brought human security to the center of the debate and anchored it in lived experience. In doing so, they not only exposed the structural asymmetries embedded in the NNPR, particularly the privileges granted to five NWS under Article VI of Treaty on the Nonproliferation of Nuclear Weapons (NPT), but also established a legal framework based on equal rights and obligations. The TPNW, therefore, represent a rejection of the absence of deadlines for nuclear weapons disarmament and the crystallization of a nuclear hierarchy. Rather than reacting to the regime from within, NNWS and civil society actors created alternative normative spaces where they could claim authority to speak, decide, and define, and proactively contest the nuclear status quo. Their action embodies the principle quod omnes tangit, central to Wiener’s (2014; 2018) approach: What touches all must be approved by all. The TPNW thus represents not only a legal innovation but also a political and symbolic rupture that reclaims agency over nuclear norm making.
