[pt] O rápido crescimento das aglomerações urbanas, trazendo na sua esteira a expansão horizontal das cidades e a segregação sócio-espacial, parece ser a antítese de um processo sustentável de desenvolvimento urbano. Em um cenário de restrições orçamentárias, o desafio dos gestores das cidades consiste em lançar mão de instrumentos de financiamento diversificados para a execução das suas políticas. Diante dos desafios impostos pelo processo de urbanização acelerado e do fracasso das soluções padronizadas de financiamento do investimento urbano, a presente pesquisa busca analisar de que forma a introdução da recuperação de mais valias urbanas como fonte alternativa de recursos para o financiamento das cidades pode contribuir para garantir a justa distribuição dos ônus e benefícios da urbanização e a promoção de cidades inclusivas. Este estudo teve como principal objetivo uma reflexão sobre a captura de uma parte das mais-valias geradas pelo desenvolvimento da cidade através do Imposto sobre a Propriedade Predial e Territorial Urbana (IPTU). Entender como esse tributo, que teoricamente está diretamente ligado ao desenvolvimento urbano e à valorização do solo, não fornece recursos aos governos locais a um ritmo correspondente às necessidades de expansão dos serviços urbanos. Esta revisão bibliográfica também se propõe a fazer uma apresentação geral dos conceitos relacionados ao tema da recuperação das mais-valias, descrevendo todo o processo, desde a Constituição de 1988 até a recriação do Ministério das Cidades em 2023.

[en] In the period following the Federal Constitution of 1988, attempts to structure urban policy in Brazil produced normative, institutional and formal effects. However, it is not an exaggeration to say that this is a construction still under development. The implementation of the City Statute, its instruments, and the construction of an urban policy that implements the right to the city, is a political institutional challenge of major proportions in a country that has a dispersed, unequal and heterogeneous network of cities. The simple definition of rights does not guarantee their implementation and attempts at regulation, via urban planning, have not yet managed to establish a clear relationship with the forces of the real estate market. With all the advances that have occurred, we still live with a housing deficit, gentrification, lack of basic services, pollution, worsening travel times. Despite the high contribution of resources directed to large centers, this did not necessarily result in benefits for the population in their daily lives. Detached from the master plans themselves and the local reality, investments in infrastructure seek to serve, above all, the private interests on the scene, in a clear movement that leads to the formation of an urban area that goes against the consolidation of the right to the city. For several decades, the development of Brazilian cities was characterized by horizontal expansion, territorial fragmentation and the lack of revitalization of urbanized neighborhoods that had fallen into obsolescence. This trend is explained by vigorous demographic growth, the massive rural exodus, persistent social inequalities and deficient urban policies. Such a diagnosis requires public policies capable of directing cities towards a more compact and resource-efficient model, in which the densification and optimization of the existing city, as well as the revitalization of urban neighborhoods, are fundamental pillars to correct imbalances in urban production.
