[pt] A assistência obstétrica é um aparato da biopolítica sobre corpos que gestam, e o direito interage com esse exercício de biopoder, legitimando-o e eventualmente limitando-o. O termo violência obstétrica foi criado nos anos 2000 por movimentos de mulheres na América Latina para identificar sofrimentos experimentados pelas mulheres no período gravídico-puerperal e está vinculado aos ideais de humanização do parto. Trata-se de conceito estratégico, que foi introduzido ao debate jurídico recentemente, mas ainda de modo incipiente, sem previsão legislativa e precisão terminológica. Sendo um tema pouco explorado no campo jurídico, é proveitoso investigá-lo no âmbito do Programa de Pós Graduação em Direito na PUC-Rio, onde o ensino crítico fomenta pesquisas com estas particularidades. Além disso, pesquisar o tratamento jurídico da violência obstétrica a partir da linha de pesquisa em Direitos Humanos, Cidadania e Democracia viabiliza um olhar menos dogmático e mais dialógico com outras áreas das ciências sociais, o que é imprescindível para tratar um tema com pouco lastro normativo. Neste contexto, essa pesquisa busca entender os conceitos violência obstétrica e humanização do parto e sua relação histórica com a apropriação do corpo da mulher como máquina reprodutiva, que provoca uma assistência obstétrica violenta e intervencionista, e questioná-los a partir da noção do dispositivo de racialidade, o qual faz com que mulheres negras sofram violências de outra ordem, decorrentes do racismo obstétrico. O trabalho propõe tais discussões à luz do Caso Alyne Pimentel, partindo da análise do julgamento do caso no Tribunal de Justiça do Rio de Janeiro e no Comitê para a Eliminação de todas as Formas de Discriminação contra a Mulher. Em seguida, desenvolve as categorias conceituais com base em pesquisa bibliográfica interdisciplinar em diálogo com marcos normativos internacionais sobre o tema, orientando-se pela noção de justiça reprodutiva. Por fim, utiliza-se do método de reescrita feminista de decisão judicial aplicado a acórdão do Caso Alyne, a fim de inserir uma perspectiva de gênero e raça à decisão, como meio de demonstrar que o direito deve responder ao problema da violência obstétrica tendo em conta que o racismo exerce papel central e estruturante nesse tema, do contrário não promoverá humanização, mas reforçará a desumanização de mulheres negras.

[en] Obstetric care is a biopolitical dispositif on pregnant bodies, and the law interacts with this exercise of biopower, legitimizing it and eventually limiting it. The term obstetric violence was created in the 2000s by women s movements in Latin America to identify suffering experienced by women during the pregnancy puerperal period and is linked to the concept of humanization of childbirth. This is a strategic concept, which was introduced to the legal debate recently, making the moment appropriate to understand the proposed categories of obstetric violence and humanization. Therefore, this research seeks to understand these concepts and their historical relationship with the appropriation of the woman s body as a reproductive machine, which causes violent and interventionist obstetric care, and to question them based on the notion of the raciality device, which causes that black women suffer violence of another order, resulting from obstetric racism. The work proposes such investigations in light of the Alyne Pimentel Case, starting from the analysis of the case s judgment at the Court of Justice of Rio de Janeiro and at The Committee on the Elimination of Discrimination against Women. Then, it develops conceptual categories based on interdisciplinary bibliographical research in dialogue with international normative frameworks on the topic, guided by the notion of reproductive justice. Finally, the Feminist Judgments method applied to the trial of the Alyne Case is used, in order to insert a gender and race perspective into the decision, as a means of demonstrating that the law must respond to the problem of obstetric violence taking into account that racism plays a central and structuring role in this issue, on the contrary, it will not promote humanization, but will strengthen the dehumanization of black women.
