[pt] A pesquisa investiga o conceito de populismo penal, explorando sua relação
com o populismo político e criticando sua aplicação no âmbito da política criminal
brasileira. O problema central consiste em questionar a adequação do conceito de
populismo penal, derivado da tradição estrangeira, à análise das dinâmicas político
criminais no Brasil, dado seu distanciamento da teoria política brasileira. A hipótese
sugere que o uso do conceito de populismo penal como categoria explicativa carece
de fundamentação teórica e metodológica sólida, pois reproduz problemas do
conceito de populismo político na ciência política. O objetivo geral é avaliar
criticamente o conceito de populismo penal, enquanto os objetivos específicos
incluem investigar sua origem, permanência e impacto, além de relacioná-lo ao
poder político e punitivo. A metodologia combina revisão bibliográfica, análise
histórica e crítica teórica, com ênfase em autores brasileiros e estrangeiros. A
pesquisa conclui pela necessidade de repensar conceitos que moldam a política
criminal e a ciência política no Brasil.
Resumo
[en] The research investigates the concept of penal populism, exploring its
relationship with political populism and criticizing its application in Brazilian
criminal policy. The central issue questions the adequacy of the concept of penal
populism, derived from foreign traditions, to analyze political-criminal dynamics
in Brazil, given its detachment from Brazilian political theory. The hypothesis
suggests that using penal populism as an explanatory category lacks solid
theoretical and methodological foundation, reproducing the problems of the
political populism concept in political science. The general objective is to critically
evaluate penal populism, while specific objectives include investigating its origin,
permanence, and impact, as well as relating it to political and punitive power. The
methodology combines bibliographical review, historical analysis, and theoretical
critique, with an emphasis on Brazilian and foreign authors. The research concludes
on the need to rethink concepts that shape criminal policy and political science in
Brazil.
