[pt] O presente trabalho, intitulado Racismo (In)visível na Justiça Juvenil: Zona do Não Ser e Resistência na Internação, investiga as manifestações do racismo estrutural na justiça juvenil brasileira, com ênfase na aplicação da medida socioeducativa de internação a adolescentes negros. A partir de uma abordagem qualitativa e crítica, aliada à experiência profissional da autora como defensora pública no estado do Rio de Janeiro, o estudo analisa como a racialização desses adolescentes é sistematicamente invisibilizada sob o discurso da neutralidade jurídica. Utilizando os aportes teóricos de Frantz Fanon, sobretudo o conceito de zona do não ser, a pesquisa evidencia a permanência de práticas punitivas e seletivas baseadas no menorismo, mesmo após os avanços normativos trazidos pela Constituição Federal de 1988 e pelo Estatuto da Criança e do Adolescente. A dissertação se estrutura em três eixos: primeiro a análise histórico-crítica da justiça juvenil e da produção de violências contra corpos negros; segundo a reflexão sobre o sistema socioeducativo como espaço de desumanização e manutenção da colonialidade do poder, do saber e do ser; e terceiro a identificação de caminhos de resistência, com destaque para o papel emancipatório da Defensoria Pública e apresentação de casos práticos de atuação da autora. A pesquisa propõe, assim, o enfrentamento das lógicas coloniais e racistas ainda vigentes, contribuindo para a construção de práticas antirracistas e de efetivo acesso à justiça para adolescentes privados de liberdade.

[en] This study, entitled Invisible (In)Racism in Juvenile Justice: Zone of Non-Being and Resistance in Incarceration, investigates the manifestations of structural racism in the Brazilian juvenile justice system, with an emphasis on the application of the socio-educational measure of incarceration to Black adolescents. Based on a qualitative and critical approach, combined with the author s professional experience as a public defender in the state of Rio de Janeiro, the study analyzes how the racialization of these adolescents is systematically rendered invisible under the discourse of legal neutrality. Drawing on the theoretical contributions of Frantz Fanon — particularly the concept of the zone of non-being — the research highlights the persistence of punitive and selective practices based on menorismo, even after the normative advances brought by the 1988 Federal Constitution and the Statute of the Child and Adolescent. The dissertation is structured around three main axes: first, a historical-critical analysis of juvenile justice and the production of violence against Black bodies; second, a reflection on the socio-educational system as a space of dehumanization and the maintenance of the coloniality of power, knowledge, and being; and third, the identification of pathways of resistance, with an emphasis on the emancipatory role of the Public Defender s Office and the presentation of practical cases from the author s professional practice. The research thus proposes to confront the still prevailing colonial and racist logics, contributing to the development of anti-racist practices and effective access to justice for adolescents deprived of liberty.
