[pt] De acordo com a teoria tradicional da responsabilidade civil, são requisitos essenciais da responsabilização o ato ilícito, o dano e o nexo causal entre o primeiro e o segundo. Com o avanço da interpretação acerca do instituto, ampliou-se significativamente as hipóteses de mitigação do primeiro requisito, transferindo-se o foco do ato ilícito para o dano injusto. Isso é feito comumente por meio do que se chama de reponsabilidade objetiva, quando o agente lesivo responde independentemente de culpa. Nestes casos, existente o dano, resta a quem se tenta atribuir responsabilidade a demonstração da inexistência de nexo causal entre qualquer conduta sua e o prejuízo causado à vítima. Mostra-se também cada vez mais comum a hipótese de uma conduta lesiva cujas consequências se desdobram em múltiplos danos, o que torna necessário limitar a extensão do dano indenizável. Neste cenário de ampliação da abrangência da responsabilização civil e de proliferação de espécies e hipóteses de danos, o nexo de causalidade mostra-se cada vez mais relevante para que se possa limitar razoavelmente a cadeia de responsabilidade civil e, da mesma forma, a extensão dos danos que merecem ser indenizados. Por isso, importante aprimorar a interpretação do nexo de causalidade, delimitando as excludentes do nexo causal que devem ser observadas pelos julgadores nos casos concretos e identificar, a partir de uma análise das decisões do Superior Tribunal de Justiça e do Tribunal de Justiça de São Paulo acerca da causalidade jurídica em casos que envolvem acidentes automobilísticos as falhas cometidas na aplicação deste instituto.

[en] According to the traditional theory of civil liability, the requirements for liability are the wrongful act, the damage, and the causal link between the first and the second. With the advancement of the interpretation of the institute, the hypotheses of mitigation of the first requirement have been significantly expanded, shifting the focus from the wrongful act to the unjust damage. This is commonly done through what is called objective liability, when the harmful agent is liable regardless of fault. In these cases, if the damage exists, it is up to the one who may be liable to demonstrate the absence of a causal link between any of their conduct and the harm caused to the victim. The hypothesis of a harmful conduct whose consequences unfold into multiple damages is also increasingly common, which makes it necessary to limit the extent of the compensable damage. In this scenario of expanding the scope of civil liability and the proliferation of species and hypotheses of damages, the causal link is increasingly relevant to reasonably limit the chain of civil liability and, likewise, the extent of the damages that deserve to be compensated. Therefore, it is important to improve the interpretation of the causal link, delimiting the excludents of the causal link that must be observed by judges in concrete cases and identifying, from an analysis of the decisions of the Superior Court of Justice and the São Paulo State Court of Justice regarding legal causality in cases involving car accidents, the failures committed in the application of this institute.
