[pt] Este texto analisa a tensão entre a liberdade de expressão, garantida pela Constituição de 1988, e o direito à honra, no contexto de discursos humorísticos. Os conteúdos humorísticos por vezes acabam por gerar litígios, com o Poder Judiciário buscando equilibrar a proteção da honra individual e a liberdade de expressão, numa equação cujo resultado é influenciado pelo fato de que a própria Constituição protege ambos os direitos, sendo certo que ambos retiraram sua força do princípio da dignidade humana. Após discorrer sobre as teorias que explicam o humor e as relações do Direito com os discursos humorísticos, passando pelos institutos da liberdade de expressão, direitos da personalidade, danos morais e responsabilidade civil, a pesquisa concentrou-se nas decisões do Tribunal de Justiça do Rio de Janeiro (TJRJ) sobre casos envolvendo humor, buscando identificar padrões nas decisões judiciais e, principalmente, tentando encontrar, nas condenações de ressarcimento por danos morais em razão da violação à honra, quais situações implicam maiores ou menores valores de indenização. Ao final, foram extraídas conclusões sobre os limites do humor estabelecidos pelo TJRJ e o valor da indenização por danos morais em casos de violação à honra.

[en] This text analyzes the tension between freedom of expression, guaranteed by the Constitution of 1988, and the right to honor, in the context of humorous speeches. Humorous content sometimes leads to litigation, with the Judiciary seeking to balance the protection of individual honor and freedom of expression, in an equation whose outcome is influenced by the fact that the Constitution itself protects both rights, with both deriving their strength from the principle of human dignity. After discussing the theories that explain humor and the relationships between Law and humorous discourses, addressing the institutes of freedom of expression, personality rights, moral damages, and civil liability, the research focused on the decisions of the Court of Justice of Rio de Janeiro (TJRJ) regarding cases involving humor, seeking to identify patterns in judicial decisions and, primarily, attempting to find, in the rulings for compensation for moral damages due to violations of honor, which situations imply higher or lower amounts of indemnification. In the end, conclusions were drawn about the limits of humor established by the TJRJ and the value of indemnification for moral damages in cases of honor violations.
