[pt] Esta tese de doutorado busca analisar as principais mudanças institucionais que afetaram a formulação e a implementação das políticas de saneamento básico no Brasil, mais especificamente aquelas envolvendo abastecimento de água e esgotamento sanitário, e seus efeitos no estado do Rio de Janeiro. O principal objetivo da investigação foi averiguar se as recentes mudanças institucionais, impulsionadas pela nova Política Nacional de Saneamento Básico, trouxeram garantias para as populações mais vulneráveis e historicamente negligenciadas. Para isso foi realizado levantamento de leis, contratos públicos e demais instrumentos administrativos e jurídicos, que determinam as condições sob as quais os serviços de saneamento básico são formulados e implementados atualmente, com ênfase nos processos de concessão à iniciativa privada no âmbito do estado do Rio de Janeiro, de serviços de abastecimento de água e esgotamento sanitário, antes prestados pela Companhia Estadual de Águas e Esgotos do Rio de Janeiro (CEDAE). A partir da análise foi possível perceber que as mudanças realizadas no período entre 2011 e 2024 apresentam mais segurança jurídica e garantias econômicas para a iniciativa privada, do que garantias sociais de acesso para as populações mais vulneráveis, principalmente as que residem em áreas de loteamento irregular e favela. Inaugurando-se uma nova fase na histórica tensão público-privada, entre a tentativa de enquadrar o acesso ao saneamento básico como direito social, e a busca por lucro da iniciativa privada.

[en] This doctoral thesis seeks to analyze the main institutional changes that affected the formulation and implementation of basic sanitation policies in Brazil, more specifically the ones involving water supply and sanitary sewage, and its effects on the Rio de Janeiro state. The main objective from the investigation was to discover if the recent institutional changes, caused by the new National Basic Sanitation Policy, brought social guarantees for the most vulnerable and historically neglected populations. For this purpose, a survey of laws, public contracts and other administrative and legal instruments which determines the conditions under which basic sanitation services are currently formulated and implemented was carried out, with an emphasis on concession processes to the private sector of water supply and sewage services within the state of Rio de Janeiro, previously provided by the Companhia de Águas e Esgotos do Estado do Rio de Janeiro. From the analysis was possible to verify that the changes made in the period between 2011 and 2024 presented more legal security and economic guarantees to the private sector, than social guarantees for the most vulnerable populations, mainly the ones who resides in irregular areas and slums. Beginning a new phase in the historical public-private tension between the attempt to frame the access to basic sanitation as a social right, and the seek for profit by the private sector.
