[pt] Este trabalho é um ensaio analítico inspirado nas obras e intervenções públicas de Luiz Werneck Vianna. Seu objetivo é examinar a conjuntura política brasileira contemporânea com base em pesquisas e insights do autor, analisando, especialmente, as diferentes maneiras pelas quais instituições políticas e instituições de justiça têm se relacionado no presente e no passado recente do país. Com base nessa análise, o artigo reforça a necessidade de valorizar o espírito da Constituição Federal de 1988 como forma de proteger a democracia brasileira neste momento de crise.

[en] This work is an analytical essay inspired by the works and public interventions of Luiz Werneck Vianna. Its objective is to examine contemporary Brazilian political situation based on the author s research and insights, analyzing, in particular, the different ways in which political institutions and judicial institutions have related to each other in the country’s present and recent past. Based on this analysis, the article reinforces the need to value the spirit of the 1988 Constitution as a way of protecting Brazilian democracy in this time of crisis.
