[pt] Este trabalho tem como objetivo analisar a questão curda no território da Turquia, mais especificamente da relação do governo turco com o Partido dos Trabalhadores do Curdistão (PKK), que é classificado como terrorista, e de prover recomendações para os atores envolvidos, visando maior possibilidade de diálogo para uma mediação e maior grau de proteção aos curdos no sentido humanitário. Na introdução, é apresentada a discussão sobre a proscrição (caracterização de atores como terroristas), assim como as informações sobre a população curda, em termos sociais, demográficos, de origem. No capítulo seguinte, faz-se uma breve contextualização sobre o histórico curdo no território da Turquia, demonstrando os desdobramentos da relação entre as partes, até chegar à fundação do PKK e o subsequente conflito com o governo turco. Nos próximos capítulos, são desenvolvidas duas questões pertinentes ao tema, principalmente nas fases mais recentes do conflito: primeiramente, é referido o debate acerca da mediação internacional e como a caracterização de atores impacta nos processos de paz, principalmente limitando a ação de agentes não estatais, também aplicando ao caso curdo; posteriormente, demonstra-se como a escolha pela proscrição pode impactar no contexto de novas guerras, prejudicando a proteção humanitária de civis curdos. Por fim, o trabalho conclui retomando a urgência de lidar com o tema de uma nação desprotegida no âmbito internacional, sugerindo recomendações que permitam maior inclusão nos processos de paz, abertura para o diálogo e mobilização na proteção humanitária.

[en] This paper has the objective of analising the kurdish issue in the territory of Turkey, more specifically about the relationship between the turkish governement with the Kurdistan Workers’ Party (PKK), that is classified as terrorists, and to provide recommendations regarding the actor involved, aiming greater possibilities of dialogue to international mediation and a bigger degree of protection to kurds, in the humanitarian sense. In the introduction, it is presented the discussion about proscription (characterization of an actor as a terrorista), as so information about the kurdish population, in terms of origin, demographics and social aspects. In the next chapter, it is made a brief contextualization about the history of kurds in the territory of Turkey, showing how the relation between both sides developed, until the foundation of the PKK and the ensuing conflict that broke out with the turkish government. In the following chapters, there is the development of two relevant questions about this theme, specially on the most recente phases of the conflict: first, there is reference on the debate regarding international mediation and how proscribing actors impacts the peace process, mainly limiting the action of non state parties, also applying on the kurdish case; then, it is shown how the choice for proscription may impact in the context of new wars, jeopardizing the humanitarian protection of kurdish civillians. To conclude, the paper resumes pointing to the urgency of dealing with the theme of an unprotected nation on the international sphere, suggesting recommendations that allow greater inclusion in peace processes, a better level of openness to dialogue and more mobilization towards humanitarian protection.
