[pt] As cláusulas morais, oriundas do direito norte-americano, foram introduzidas, em seus primórdios, nas contratações que possuíam como pano de fundo o cenário hollywoodiano. A disposição contratual objetivava modular comportamentos dos artistas contratados – que cediam onerosamente sua imagem - e minimizar eventuais danos que estes poderiam causar aos contratantes ao realizarem atos em sua vida pública e privada que viessem a impactar o bom andamento do programa contratual. No Brasil, com o advento da internet e a massificação da comunicação, verificou-se o uso mais incidente da imagem na sociedade atual. Contudo, o desenvolvimento teórico acerca da tutela da cláusula moral ainda se revela tímido, o que fez com que o presente trabalho propusesse três chaves classificatórias sobre as situações subjetivas tuteladas por meio dessas cláusulas: as que proíbem o envolvimento em atos ilícitos; as que proíbem que o contratado ou contratante se envolva em situações amorais; e as cláusulas morais que limitam (voluntariamente) a autonomia existencial, sendo esta última objeto central do presente estudo. Delimitado o tema, o presente trabalho investiga as situações jurídicas dúplices e os direitos da personalidade, concluindo que o art. 11 do Código Civil veda, somente, a disposição permanente dos direitos da personalidade, possibilitando sua limitação temporária. Assim, a partir dessa conclusão, pretende-se trazer critérios de validades das cláusulas morais em que o contratado limita, voluntariamente, sua autonomia existencial. Desse modo, será proposta a análise da validade dessas cláusulas por meio de seu alcance, duração, intensidade, finalidade, voluntariedade e revogabilidade.

[en] The moral clauses, originating from American law, were initially introduced in contracts that had as their backdrop the Hollywoodian scenario. The contractual provision aimed to modulate the behaviour of the contracted artists —who commercially licensed their image— and minimize any potential damages they could cause to the contractors by engaging in acts in their public and private lives that could impact the smooth running of the contractual program. n Brazil, with the advent of the internet and the widespread communication, the use of image in today s society became more frequent. However, the theoretical development regarding the protection of this clause still appears timid, which led the present work to propose three classificatory keys on the subjective situations protected through these clauses: those that prohibit involvement in illegal acts; those that prohibit the contracted party or contracting party from engaging in amoral situations; and moral clauses that limit (voluntarily) existential autonomy, the latter being the central object of the present study. With the theme delimited, this paper will investigate dual legal situations and personality rights, concluding that Article 11 of the Brazilian Civil Code only prohibits the permanent disposal of personality rights, allowing for their temporary limitation. Thus, based on this conclusion, it is intended to bring validity criteria for moral clauses in which the contracted party voluntarily limits their existential autonomy. Therefore, an analysis of the validity of these clauses will be proposed through their scope, duration, intensity, purpose, voluntariness, and revocability.
