[pt] A dissertação investiga a não relativização da incapacidade dos maiores de 16 anos a certos atos ou à maneira de os exercer, assegurada no artigo quarto do Código Civil, nas pesquisas em seres humanos no Brasil. Reguladas pela Resolução número 466 do Conselho Nacional de Saúde, a capacidade plena é o único critério para o consentimento direto. Propõe-se dispensar a intervenção da autoridade parental em pesquisas que (i) sejam consideradas de baixo risco à integridade biopsicofísica dos participantes; ou (ii) possam macular o direito à privacidade, intimidade ou autonomia corporal dos menores. Isso porque o viés da hermenêutica deve fomentar a autonomia responsável e virtuosa de natureza emancipatória, favorecendo a busca pelo discernimento e o incremento da maturidade pelos jovens. A fim de promover o desenvolvimento dos menores sem embaraços, suscita-se (i) redefinir o parâmetro da capacidade plena como secundário – ou não exclusivo; (ii) deferir aos menores maiores de 16 anos a mesma autonomia do alistamento eleitoral, desde que compatível a liberdade de participar de certas pesquisas com os certos atos da vida civil; e (iii) desigualar o tratamento do acesso a pesquisas entre menores incapazes de forma absoluta e relativa. A busca pela medida adequada de aplicação do regime das incapacidades é magnificada pela Constituição, a qual preconiza respeito à autonomia das pessoas em desenvolvimento, notadamente os relativamente incapazes, quase adultos, dotados da mais ampla liberdade responsável. Regulação que limite liberdades com fundamento exclusivo na capacidade plena deve avaliar o merecimento de tutela civil-constitucional do jovem relativamente incapaz.

[en] The dissertation investigates the possible enforcement denial to Brazilian Civil Code article 4 when deferring the relativization of minors s incapacity over 16 years old to certain acts or the way of exercising them. In the case of research involving human beings in Brazil, regulated by Resolution No. 466 of the National Health Council, the full civil capacitiy is the only criteria for autonomous consent. It is proposed to exempt the need for parental authority intervention for research that is (i) of low risk to biopsychophysical integrity of the participants; or (ii) when it involves protection of the right to privacy, notably in cases in which minors must be preserved in their intimacy. The hermeneutics bias should encourage responsible and virtuous autonomy of an emancipatory nature, favoring the search for discernment and the maturity flowering by young people. In order to promote the development of minors without embarrassment, there is a need to (i) redefine the parameter of the full civil capacity as secondary – or non-exclusive; (ii) granting minors over 16 years old access to the same autonomy as when they get enrolled to voting registration, since such liberty is compatible with certain acts of civil life; and (iii) unequaling treatment among absolutely and relatively incapable minors. The search of the adequate measuement of inequality settled down by the Civil Code is magnified by the Federal Constitution, which envised broadest responsible freedom regarding almost adults. Any regulation that restricts freedom sole based upon full civil capacity must evaluate the deserving autonomy or not in accordance with civil-constitutional rule of law applying to civil capacity relativization.
