[pt] O presente trabalho, visa realizar uma análise comparada da teoria tridimensional de Miguel Reale e a teoria de direito natural clássica de José Pedro Galvão de Sousa. No primeiro capítulo, analisa-se a teoria tridimensional de Reale, buscando ressaltar o seu contexto de surgimento, a sua distinção face ao tridimensionalismo abstrato, os seus fundamentos dialéticos, ontognoseológicos e históricos axiológicos e sua relação com o direito natural. No segundo capítulo, será analisada o direito natural na obra de Galvão de Sousa, a sua introdução com a crítica ao positivismo, as bases do direito natural de matriz aristotélico-tomista, a relação com o jusnaturalismo moderno; chegando a aplicação de um direito natural de matriz histórico-positiva face as consequências jurídicas oriundas do estado moderno. Por fim, busca-se mediante o terceiro capítulo realizar uma comparação das teorias, acerca do positivismo jurídico, do debate do direito natural e da necessidade da norma constituir-se como reflexo da realidade histórica; analisando, em conclusão, os pontos de convergência e as divergências essenciais.

[en] This paper aims to conduct a comparative analysis of Miguel Reale s tridimensional theory and José Pedro Galvão de Sousa s classical natural law theory. The first chapter analyzes Reale s tridimensional theory, seeking to highlight its context of emergence, its distinction from abstract tridimensionalism, its dialectical, ontognoseological, and historical-axiological foundations, and its relationship with natural law. In the second chapter, the natural law in Galvão de Sousa s work will be examined, including its introduction with the critique of positivism, the foundations of natural law rooted in Aristotelian-Thomistic thought, and its relationship with modern jusnaturalism. This chapter will also explore the application of a historically-positive natural law in response to the legal consequences arising from the modern state. Finally, the third chapter aims to compare the theories in terms of legal positivism, the debate surrounding natural law, and the necessity for the norm to reflect historical reality. In conclusion, the paper will analyze the points of convergence and essential divergences between the two theories.
