[pt] A dissertação estuda a aplicação do instituto do abuso do direito no âmbito do condomínio edilício, buscando estabelecer parâmetros para identificar e controlar o abuso nas decisões assembleares. Para tanto, a dissertação, em seu primeiro capítulo, analisa a natureza jurídica da convenção de condomínio, estabelecendo as premissas de interpretação da convenção e definindo as formas de controle a que estão sujeitas as decisões assembleares, notadamente do instituto do abuso do direito e, subsidiariamente, do merecimento de tutela. Em um segundo capítulo, apresenta análise histórica e conceitual do instituto do abuso do direito no âmbito do condomínio edilício, estabelecendo as premissas conceituais necessárias acerca do instituto para permitir a sua análise no controle do abuso nas decisões assembleares. Ainda neste segundo capítulo, são estudados cada um dos critérios legais do abuso do direito (boa-fé; fim econômico e social; e bons costumes), bem como são apresentados os seus efeitos, ambos levando em consideração as relações condominiais. Por fim, o terceiro capítulo realiza a aplicação de cada um dos critérios legais do abuso do direito em três diferentes hipóteses.

[en] The dissertation studies the application of the abuse of right institute in the scope of the building condominium, seeking to establish parameters to identify and control the abuse in assembly decisions. Accordingly, the dissertation, in its first chapter, analyzes the legal nature of the condominium agreement, establishing the premises for the interpretation of the agreement and defining the forms of control to which the assembly decisions are subject, notably the institute of abuse of right and, alternatively, the merits of guardianship. In a second chapter, it presents a historical and conceptual analysis of the abuse of rights institute in the context of the building condominium, establishing the necessary conceptual premises about the institute to allow its analysis in the control of abuse in assembly decisions. Still in this second chapter, each of the legal criteria of the abuse of right are studied (good faith; economic and social purpose; and good customs), as well as their effects are presented, both considering condominium relations. Finally, the third chapter performs the application of each of the legal criteria of the abuse of right in three different hypotheses.
