[pt] A aprovação da Lei Federal n. 13.465 em 2017 contribuiu para uma significativa mudança
paradigmática quanto ao tratamento da questão da regularização fundiária urbana no Brasil – indo contra o marco conceitual e jurídico mais amplo construído no país desde o final da década de 1970, e ignorando as muitas lições da experiência internacional sobre o tema. Neste artigo me proponho a recuperar a trajetória dessa discussão no Brasil, assim como a organizar o que já se sabe como resultado de décadas
de reflexão e ação sobre a questão no contexto internacional.
Resumo
[en] The enactment of Federal law 13465 in 2017 has contributed towards a significant paradigmatic
change regarding the treatment of the matter of urban land regularisation in Brazil – going against the broader conceptual and legal framework constructed in the country since the late 1970s and ignoring the many lessons from the international experience on the matter. In this article I aim to recapitulate the course of this discussion in Brazil, as well as organising what is already known as a result of decades of reflection and action on that matter in the international context.
