[pt] O presente trabalho enquadra-se na linha de pesquisa Teoria do Direito, Ética e Construção da Subjetividade e tem por objetivo refletir acerca de uma abordagem não patriarcal da construção da subjetividade a partir da obra do psicanalista inglês Donald W. Winnicott. Para tanto, aponta-se a perspectiva patriarcal da constituição do sujeito que estaria presente no trabalho teórico de Freud, apesar de suas descobertas não patriarcais na experiência clínica psicanalítica, e as modificações matriciais que a teoria do desenvolvimento emocional primitivo winnicottiana trouxe. Mobiliza-se o conceito de patriarcado de Maturana e de Verden-Zoller como um espaço psíquico no qual o conflito, as hierarquias, a dominação da natureza e a regulação do humano antissocial são valorizados. De modo diverso, o espaço psíquico matricial valoriza a harmonia, a empatia, a colaboração e a alteridade, encontrando-se na relação materno-infantil. Desenvolve-se o objetivo proposto a partir da diferença na relação indivíduo/sociedade na obra de Freud e na de Winnicott, o que se reflete no modo diverso como percebem a ambivalência, a agressividade, o sentimento de culpa, a formação do superego, a ética e a relação do sujeito com objetos externos. Por fim, propõe-se o conceito winnicottiano de democracia enquanto um conjunto de subjetividades maduras como uma forma de levar o viver matrístico da relação materno-infantil para a vida adulta e para vínculos mais amplos (família, escola e sociedade).

[en] The present work is part of the research line Theory of Law, Ethics and Construction of Subjectivity and aims to reflect on a non-patriarchal approach to the construction of subjectivity from the work of the english psychoanalyst Donald W. Winnicott. For this, it is pointed out the patriarchal perspective of the constitution of the subject that would be present in the theoretical work of Freud, despite his non patriarchal discoveries in psychoanalytic clinical experience, and the matricial modifications that the winnicottian theory of primitive emotional development brought. The concept of patriarchy of Maturana and of Verden- Zoller is mobilized as a psychic space in which conflict, hierarchies, domination of nature and the regulation of the antisocial human are valued. In a different way, the matricial psychic space values harmony, empathy, collaboration and otherness, being found in the mother-child relationship. The proposed goal is developed from the difference in the individual/society relationship in the work of Freud and Winnicott, which is reflected in the different way in which they perceive ambivalence, aggressiveness, guilt, the formation of the superego, ethics and the relation of the subject to external objects. Finally, the winnicottian concept of democracy is proposed as a set of mature subjectivities as a way of bringing matrístico from the mother-child relationship into adult life and into broader ties (family, school and society).
