Resumo:
This doctoral thesis aimed to analyze the role of the Judiciary in confronting social issues in contemporary scene, from the study in civil interdiction processes of people with mental disorders which were transating in a Family Court of Volta Redonda, in Rio de Janeiro. The results showed, in general, that the demands that emerge in interdicition processes translate the various expressions of social issues experienced by people with mental disorders, whose confrontation reveals the transfer of the Executive responsibilities to the Judiciary regrading the guarantee of social rights and social protection. However, the role of Judiciary is built under a judiciak process that deprives the subject of the enjoyment of their civil and political rights, which highligghts the coercive face of the state in order to control this part of the population. The walls of asylums were replaced by the invisible bonds of civil interdiction, which did not alter the Mad citizenship status as desired by the psychiatric reform. Such transfer of responsibilities sets, thus, the phenomenon of the judicialization of Social Issues. In a context marked by significant changes in the relationship State-Society, processed since the last decades of the 20th century, we belive that the judicialization of social issues is the effect of the reconfiguration of the coping mechanisms of the social question, led in particular by the state, which energize punitive and repressive practices against the working class to contain their movements, rebellions and forward reactions to experienced social inequalities.
