This doctoral thesis, entitled The Protection of Victims of Violent Crimes in the Brazilian Legal-Constitutional Order from the Perspective of Fundamental Human Rights, investigates how Human Rights can structure a legal-normative system that effectively ensures the fundamental human rights of victims of violent crimes, overcoming the predominantly symbolic and programmatic approach currently in place. The study finds that while the rights of the accused are extensively protected under Brazilian law, victims of violent crimes remain marginalized and unprotected within the legal process, revealing a significant disparity in the treatment afforded to these parties. Employing a qualitative methodology and an interdisciplinary approach, the research adopts a theoretical and documentary analysis grounded in analytical-deductive and dialectical reasoning. This framework allows for an in-depth understanding of the relationship between Human Rights and the fundamental rights of victims. Among its principal contributions, the dissertation proposes a legal-normative system grounded in Human Rights that guarantees the effectiveness of victims rights, moving beyond a conception of merely programmatic rights. The thesis articulates Marcelo Neves s theory of symbolic constitutionalism with the theory of fundamental rights developed by scholars such as Robert Alexy, Jorge Miranda, Bodo Pieroth, and Bernhard Schlink. It offers a theoretical framework that identifies the limitations of the current legal system and proposes practical solutions for the Brazilian legal order. The research underscores the importance of an interdisciplinary perspective in the study of Human Rights, fostering dialogue among various fields of knowledge to address the challenges associated with victim protection. As such, it contributes to strengthening the Brazilian legal-constitutional order by proposing a reformulation that guarantees dignity, security, and justice for victims of violent crimes.
