The climate crisis is considered by many to be the greatest crisis of humanity. Much of the global community finds itself in alarming situations of environmental vulnerability, facing droughts, floods, hunger, and various climate-related diseases. Among its consequences is the forced displacement of millions of people, an estimative which is increasing exponentially. Although most of these displaced remain within the borders of their state of origin, some decide to cross these geographical boundaries, migrating to another country. If, on the one hand, the emergency experienced by these subjects is more prominent in academia and in the media, especially because of the political actions of island countries that face rising sea levels and, therefore, their disappearance, on the other hand, there is a lack of action regarding the legal construction and the public policies that mitigate the absence of rights here. It is also noted that even with the advancement of research related to the climate emergency, the accountability of those who historically affect the environment the most is still a debate that remains in parallel. The present paper aims to collaborate with the side that is still poorly highlighted in the context of climate forced displacement - who the subjects are, how the law can act to protect them, and how to think about reparation policies in the socio-climatic context.
